Abstract
This research problem revolves around the legislative shortcomings and legal challenges arising from the misuse of modern communication technologies, especially with the rapid development of digital technologies and the proliferation of criminal acts committed through them. This renders traditional criminal texts insufficient to address these crimes, whether in terms of the nature of the act, the means of its commission, or the scope of its transnational effects. The research raises fundamental questions about the extent to which current criminal legislation can encompass these crimes and the adequacy of existing texts in criminalizing and punishing perpetrators, in addition to the legal basis for criminal liability for them. The importance of this research lies in highlighting the seriousness of these crimes and their effects on social values, community security, and individual rights, shedding light on legislative deficiencies, and demonstrating the pivotal role of criminal liability in achieving deterrence. Furthermore, it contributes to enriching the legal literature with an analytical study and supports legislative and judicial efforts to achieve a balance between protecting society and preserving rights and freedoms in the digital environment.
