The contracts concluded by the state, referred to as governmental contracts, are the means by which the state acquires its needs for materials, machinery, and other constructions. Since the state is the legitimate representative of the people, and public funds are constitutionally owned by the people, their protection becomes a duty for those responsible for managing them. Therefore, Iraqi legislation has outlined procedures and methods to prevent misuse and exploitation of these funds through the processes and mechanisms involved in concluding these contracts, ensuring that public interest is served and adopting the principle of transparency, which allows easy and flexible access to information. The study of our research entitled (Guarantees granted to the administration within the framework of government contracts in Iraq) required adopting the scientific (analytical) method, as it is the most effective and compatible method with our topic, which requires in many places to rely on this method, which sometimes approaches the method of explaining texts.
