Abstract
This research deals with one of the most important topics related to the transfer, which is the legal provisions related to the lapse of the right of the negligent legal holder, as the Iraqi legislator has devoted many articles to address the transfer, due to the importance of this transfer in commercial business, but due to the wide scope of dealing in the transfer at the international level, and to preserve its legal value, its special laws worked to address it at the domestic level, but it did not receive treatment at the international level and remained far from actual application in many countries, despite the existence of an international agreement regulating the issue of conflict, such as the Geneva Convention of (1930-1931), which represents the backbone of solving the problem of conflict of laws in the transfer, and Iraq is no longer one of the countries organizing this agreement, which necessitated stating that importance and highlighting the cases of the lapse of the right of the negligent holder, and the law applicable to the lapse of his right by stating the opinions of jurisprudence
