Abstract
The significance of legislative procedures and their compliance with constitutional provisions is undeniable, as any deviation from these norms results in constitutional defects subject to the authority and oversight of constitutional courts. This necessitates special attention to both the formal and substantive integrity of legislative processes, as these procedures form the cornerstone of sound legislation. Any infraction, whether minor or severe, leads to a constitutional violation.
Constitutions often emphasize the importance of legislative procedures by clearly delineating the legislative initiative between the executive and legislative branches. Some of these procedures are assigned to the legislative authority, while others fall under the executive’s purview. Additionally, constitutions specify the required majority for the validity of these procedures, making any departure from these constitutional provisions a formal defect easily identifiable by constitutional courts.
Constitutional documents also encompass numerous substantive rules and restrictions that the legislative authority must adhere to when regulating various rights and freedoms. Deviation from these core legislative objectives manifests in two primary forms: a deviation from the intended purpose and a violation of the subject matter. Together, these substantive restrictions represent a significant breach of legislative integrity if the legislature disregards them, thus necessitating intervention by the constitutional judiciary to limit such transgressions.
