The guarantee in Iraqi law means that a person guarantees what he may damage for things placed in his possession and which are owned by others. Iraqi law has the uniqueness of being unique from other laws in the matter of bearing the consequences of the destruction of money owned by others and placed in his possession. Iraqi law has provided a special system for guaranteeing the hand, so that the hand is a guarantee to this owner of the thing with the intention of owning it. The hand turns from being a trust to being a guarantee hand in the event that the owner of the hand, even without the intention of ownership, has withheld the thing from its owner without having the right to do so or obtaining his consent. The provisions of the guarantee vary between the reasons for it, which vary between legal actions and material facts.
