Abstract

Peoples all over the world in general and the Islamic people in particular in the age of globalization and technology, encounter poverty, ignorance and diseases, that Waqf attempted to deal with in several countries as it is no longer limited to the local scope, but began to expand and develop by conveying its benefits to other countries that face economic, social and cultural problems to embed and support the spirit of cooperation and interdependence between the peoples. Therefore, the individual became global and the foreign element came into his/her relationships, whether that element is in the side of the endowing person or the fund which is the subject of the Waqf and this led to the conflict amongst the laws in terms of the application of these laws to the Waqf. So, this research came to deal with the problem of laws conflict in the issues of Waqf, if the relation within it involves a foreign element.
