Abstract
Technical development has produced multiple services that cannot be dispensed with because they affect the needs of individuals on the one hand and the country’s economies on the other hand. In the face of this development, the laws related to regulating communications in Iraq have become unable to regulate this activity, so the legislator decided to create the formation of the Media and Communications Commission under “ Coalition Provisional Authority Order No. 65 of 2004 “which regulates and supervises mobile phone contracts and imposes penalties on companies violating licensing conditions. The administration has the right to determine the occurrence of a violation and impose the appropriate and proportionate penalties specified by Order No. 65 of 2004 in order to regulate this type of service.
The scope of the research is determined by explaining the penalties that the administration can impose as a result of breaches of licensing contracts, in light of the Permanent Constitution of the Republic of Iraq for the year 2005, the Coalition Provisional Authority Order No. (65) of 2004, and the licensing contracts that the Authority concluded with licensed companies, as well as the regulations and instructions it issued. The Authority to regulate telecommunications work in Iraq in general.
