Abstract
This study examines the concept of electronic enticement (takhbib), defined as corrupting one spouse against the other through modern communication technologies. It analyzes its linguistic, juristic, and legal definitions, as well as its various forms affecting either spouse. The research affirms its prohibition in Islamic law, considering it a grave sin due to its destructive impact on family stability and social cohesion. It also evaluates the position of the Iraqi legislator in Personal Status Law No. 188 of 1959 and Penal Code No. 111 of 1969, comparing it with Jordanian legislation, and proposes explicit legal provisions criminalizing such acts to safeguard marital bonds. The research aims to:
1. Clarify the concept of online incitement to discord and its impact on married life.
2. Establish the legal and religious rulings regarding online incitement to discord within the context of marriage contracts.
3. Examine the legitimacy of a marriage contract between a man who incites discord and a woman he has incited against her husband. Similarly, if the woman is the one incited, is her marriage to the man she corrupted against his wife permissible or not, according to Islamic law and the law of the land?
