Abstract
The spread of information and communication revolution in nowadays have led to emehence the ara of electronic store is being as an expedient of doing commercial business as the traditional (material) store. The electronic store is premised on material and moral elements distinct somewhat to those should be provided in the traditional store, which is necessitates to be govern by distinctive rules. Recently, the Iraqi Regulation of Electronic Trade Regulating No. (4) 2025 has been enacted and contained rules governing some aspects of electronic store. The Regulation has experienced lacuna in drafting some rules and legislative-holes in dealing with some matters.
this article will focus on these defects on the aforementioned Regulation by the adoption of doctrinal and comparative methods of study with the law of both Saudi Arabian and the U.A.E.
A thorough understanding of the aforementioned concepts necessitates two sections: the first will address the concept of an online store, while the second will define the store as a means of conducting e-commerce, examining its components. This study will conclude with a summary of our findings and recommendations for developing the legal framework governing e-commerce.
