This research addresses the criminal liability of public employees for abuse of power in light of Iraqi legislation and the impact of this phenomenon on efforts to combat administrative corruption in state institutions. The importance of the topic stems from the widening scope of violations committed by some public employees, despite the existence of legal texts criminalizing such acts. This raises questions about the effectiveness of the legal system and the state's ability to regulate job performance in accordance with the principles of transparency and accountability.
The researcher sought to analyze the legal basis for criminal liability by clarifying the unlawful acts committed by public employees, such as bribery, abuse of influence, embezzlement of public funds, and other forms of job misconduct.
The study also highlighted the role of oversight bodies, such as the Integrity Commission and the Board of Supreme Audit, in curbing these phenomena. The study adopted a descriptive and analytical approach, employing a comparative approach to clarify the differences and similarities between Iraqi legislation and some Arab and international legislation. It also utilized a critical approach to highlight the shortcomings and gaps in current laws. The study concluded that abuse of power poses a direct threat to public service, and that addressing the phenomenon requires comprehensive legislative and administrative reform.
