This research examines the issue of surrogacy in Iraqi law using a comparative analytical approach . It examines prominent figures to demonstrate the Iraqi legislators position on this phenomenon in light of the absence of legal texts and their legal implications , The research presents the legal jurisprudential framework for surrogacy , explaining the contracts pillars and legal implications . It also covers the legitimacy of the issue according to various Islamic schools of thought . It compares the Iraqi situation with Arab commercial experiences . It concludes by presenting digital tools in this sensitive field .
Regarding the methodology of our research, in order to study this research, we rely on the comparative analytical method, through analyzing the opinions of jurists and comparing Iraqi law with the laws being compared.
To cover this topic, we will divide our research into two sections. In the first, we will explain the theoretical and jurisprudential framework for surrogacy. In the second section, we will explain the legal regulations and legal controls governing surrogacy.
