Abstract
This research aims to study commercial contracts in light of digital transformation within the framework of Iraqi commercial law, while providing a comparative analytical perspective with foreign legislations. It highlights the significance of digitalization in commercial contracts and its impact on the principles of consent, evidence, and enforcement, as well as the legal challenges related to consumer protection, cybersecurity, and the recognition of electronic evidence. The research adopts a comparative analytical method to identify strengths and weaknesses in Iraqi legislation and propose suitable solutions.
The importance of this research stems from its addressing a modern topic that touches on the core of commercial activity, reflecting the shift from traditional paper-based contracts to digital contracts. Furthermore, the comparative study between Iraqi law and other comparative laws (Egyptian, French, European) provides the opportunity to benefit from pioneering experiences and present proposals for developing Iraqi legislation.
