Abstract
Crimes of attacking means of communication are crimes that target wired and wireless systems. The Iraqi legislator has regulated their provisions and allocated them to some legal articles, and specified their forms and penalties for their perpetrators. These crimes may be intentional with criminal intent or unintentional, and in both cases their perpetrators are punished However, in light of the great technological progress and development in the means and creation of wide electronic networks for communications, the provisions of the law have become insufficient to confront the attacks on these means. In view of this and that, the Iraqi legislator must intervene to confront the emerging crimes that affect the means of communications.
We have dealt with this research in two sections. The first section dealt with the conceptual framework of crimes of assault on means of communication in two requirements. The first of them included a definition of the crime of assault on means of communication. As for the second requirement, we devoted it to examining the nature of the crime of assault on means of communication. In the second section, we examined the provisions of the crime of assault on means of communication. We divided it into two requirements. We devoted the first of it to examining crimes of assault on means of communication intentionally, while in the second we examined crimes of assault on means of communication unintentionally.
