Abstract
Incubation is an agreement under which an incubator, which may take the form of a state, public utility institutions or even a private company, undertakes to provide financial support and/or services to an incubatee for a certain period of time in order to enable it establishing its own idea, developing his own commercial business or his/her small company. Therefore, incubation is an expedience to perform several goals, such as gaining a benefit to the incubatee, achieving public interests, e.i, combating unemployment, developing and creating competition between creative economic units and developing innovations and national economy as all.
Despite the great significance of incubation, legal jurists pay no attention in clarifying the legal rules governing such activity. Moreover, in spite of the enactment the Support of Small Business Income Generating Act of 2012, the aforesaid Act failed to handle several matters, such as, the agreement of incubation, its characteristics and the aspects of distinguishing it from other spectrum of contracts, how to motivate other commercial units to provide a support to other new business.
