Abstract
The existence of a legal system at the international level that promotes the conservation of biological diversity represented by: The 1992 Convention on Biological Diversity needs to be strengthened and strengthened in its implementation, and to detail some of its general provisions. Therefore, the Nagoya Protocol came as an imperative to enhance the protection of genetic wealth and determine the rights of sovereignty over it for countries with genetic resources. This research discusses the international legal rules for access to resources. Genetic resources and the sharing of the benefits arising therefrom (according to the 2010 Nagoya Protocol to the Convention on Biological Diversity). Therefore, it was necessary to study this protocol to determine its effectiveness in protecting the rights of states over genetic resources.
