The Contracts concluded by the Minor under the English Common law are classified into Contracts valid at common law، Contracts voidable at common law. and Void contracts at common law. It is worth-bearing in mind that the valid contracts are sub-categorized into Contracts for necessaries، and Beneficial contracts of service for minors. The contracts concluded by the drunken are sometimes valid، and void in other cases. The same is true for the contracts concluded by the mentally disordered persons. Whereas the Iraqi Civil Law No. (40) of 1951، classified the contracts according to the capacity into contracts purely profitable and purely harmful، and contracts which are at the same time profitable and harmful. And the Iraqi law of care of minors No. 78 of 1980 defines both the minor and the infant
