The research revolves around a statement of the legal effects of referring a public employee to retirement, highlighting the deficiencies in the legislation in force in Iraq and the extent of judicial oversight of that and comparing it with other foreign and Arab legislations (France - Britain - America - Egypt - Saudi Arabia - Jordan), and a statement of the regulations that these countries adopt. And its judicial vision, Also, this issue is important in the employee’s life because it has a social and psychological impact on which it is built, as retirement is like an end-of-service compensation for an employee who has spent part of his life serving the state. For retirement, we also discuss the role of the judiciary in monitoring legislation and administrative decisions in settling pension disputes.
