When the qualities of the contractor or his person are taken into consideration in the contracting contract, the contractor is obligated to personally implement his obligation, whether it is to do an act or refrain from doing an act. Sonetiwr the contractor is exposed to cireumstanees that preuent him from carrying out obligatim solt, such as furbidding insolvency whie causes a defect in the implementation at the contract as well. Certain effects ther cast a shadow on the contractor and the employer, and the personal implementation of the contractor in the Iraqi civil law differs from Islamic jurisprudence in terms of scope and judgment, which is what we discussed in this research paper through the comparison between them.
