Due to the huge technological progress that has swept the world today، including the emergence of smart robots that is able to think and innovate in light of the legislative vacuum، whether in Iraq or Egypt، which requires the intervention of legislators to enact legislation compatible with these smart systems. In the light of this came our research، which is entitled the legal protection of the patent for smart robots، adopting the comparative analytical approach to show the extent of the legal protection of the patent reached by the smart robot. In this research، we concluded with a set of recommendations، the most important of which is that smart robots are able to simulate humans، in addition to solving problems quickly without any human intervention، which requires the need to protect its innovations. In addition to how to protect these innovations linked to the recognition of their legal personality. As a result، we reached a set of recommendations، the most important of which is urging the legislator to develop a law that is in line with smart robots because the current traditional rules in the Iraqi and Egyptian legislation are not appropriate to absorb such new technology. Which requires the intervention of legislators to amend the legal texts to accommodate this new birth because it has become inevitable
