The legal studies about English law have special features that distinguishing this law from other regimes, there is a focus on parties' autonomy and intent throughout the conclusion of all that matters around the contract, and analyzing these matters logically in order to reach a desired rules based on equity. The exemption clauses are an important issue in this scientific approach, which attained a distinct regulation in English law. This regulation is adopting a deep conclusion of facts and conditions to reaching to true intention of parties. The English courts, however, don’t accept to enforcement these clauses if they cause harm to the promisor. We deal with this English approach about exemption clauses hoping take the advantages of it.
